Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and 1w Boxing Trainer developed by MyEdhulight- AzxMatrix ("we," "us," or "our") governing your access to and use of the PocketSpar mobile application ("App").

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

Eligibility

You must be at least 13 years of age to use this App. If you are between 13 and 18 years of age, you represent that you have your parent's or legal guardian's permission to use the App and that they have read and agreed to these Terms on your behalf.

By using the App, you represent and warrant that you have the legal capacity to enter into these Terms and that you will comply with all applicable local, state, national, and international laws and regulations.

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial use.

This license does not include the right to:

  • Modify, adapt, translate, reverse engineer, decompile, or disassemble the App
  • Create derivative works based on the App
  • Copy, distribute, or disclose any part of the App
  • Use the App for any commercial purpose without our written consent
  • Remove, alter, or obscure any proprietary notices in the App
  • Use the App in any way that violates applicable laws or regulations

User Content

The App may allow you to create, store, and manage content such as workout plans, training notes, and personal fitness data ("User Content"). You retain ownership of any User Content you create.

By creating User Content, you represent that:

  • You own or have the necessary rights to the content you create
  • Your content does not violate the rights of any third party
  • Your content complies with all applicable laws and regulations

You are solely responsible for your User Content and any consequences of creating or sharing it.

Health and Fitness Disclaimer

Important: The App is designed to assist with boxing training and fitness tracking. However, it is not a substitute for professional medical advice, diagnosis, or treatment.

Before beginning any exercise program, including those suggested or tracked by this App, you should:

  • Consult with a qualified healthcare professional
  • Understand your physical limitations and health conditions
  • Start slowly and progress gradually
  • Stop exercising immediately if you experience pain, dizziness, or discomfort

We are not responsible for any injuries, health problems, or other damages that may result from your use of the App or participation in any exercise activities. You assume all risks associated with your physical training.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App in any way that violates any applicable law or regulation
  • Attempt to gain unauthorized access to any part of the App or its systems
  • Interfere with or disrupt the integrity or performance of the App
  • Transmit any malware, viruses, or other harmful code
  • Harvest or collect information about other users without consent
  • Use the App to engage in any fraudulent or deceptive activity

Intellectual Property

The App and its original content, features, and functionality are owned by 1w Boxing Trainer developed by MyEdhulight- AzxMatrix and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks, service marks, logos, and trade names may not be used in connection with any product or service without our prior written consent.

Updates and Modifications

We reserve the right to modify, update, or discontinue the App at any time without prior notice. We may release updates to the App that add new features, fix bugs, or address security issues.

You agree that we shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Any errors in the App will be corrected
  • The App will meet your specific requirements or expectations

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL 1W BOXING TRAINER DEVELOPED BY MYEDHULIGHT- AZXMATRIX, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

Our total liability to you for all claims arising from or related to the App shall not exceed the amount you paid us, if any, for access to the App during the twelve (12) months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless 1w Boxing Trainer developed by MyEdhulight- AzxMatrix and its affiliates, directors, officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any User Content you create or share

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 1w Boxing Trainer developed by MyEdhulight- AzxMatrix regarding the use of the App and supersede any prior agreements or understandings.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page.

Your continued use of the App after any changes indicates your acceptance of the modified Terms. We encourage you to review these Terms periodically.
